      IANAL (I just love that acronym).

      Is what SBN wants you to agree to something it’s asking every user to agree to, or is is specific to you, or is it limited to moderator-types? If it’s the former, it’s an End-User License Agreement, the enforceability of which varies greatly. For some laughs, go to boingboing.net and search for EULAs…some sites try to insist on some pretty ludicrous agreements from their users.

      If it’s the latter, something only mods must agree to, then it’s probably more meaningful (good or bad) and more enforceable, since it sounds like a contract you’d be entering into, the reward for which is whatever it is you find rewarding about being a mod (i.e., not very much at all).

                No. That’s the first thing you learn after law school. And it’s important. The attorney/client relationship is critically important. It is protected in lots of ways other relationships are not, and it imposes various duties upon the attorney that are not owed to others.

                Unfortunately, the bar for establishing the relationship is unclear and low. If I were to read the contract and tell LB it was ok, he would have the unquestionable right to sue me for malpractice if I was wrong. It isn’t that I think he would do that, it’s that if you take that risk enough times someone will.

    1. I hope that the producers don’t bring Ivy back as an “assistant” during the finals just to stir up crap. She is such a bitter, bitter woman. I loved the editing when she said she believed in karma and then they showed her sewing machine breaking and hitting her in the face. The producers must really hate her.
    2. Gretchen is talented, but I’m tired of her personality. She just really cannot take criticism (which, to be fair, I’m pretty bad at as well.) But when you’re in it to win it as much as she is, you’ve really got to suck it up and take the judges feedback to heart–otherwise you’re just wasting your opportunity.
    3. An obvious example, what were Gretchen and Mondo thinking getting in Heidi’s face like that? So stupid.
    4. That being said, I do love Mondo and I hope he wins.
    5. I wanted to root for Christopher since he was the Bay Area link, but he just brought nothing to the table, personality or design-wise.
    6. April doesn’t do much for me and she’s also a bit of a sour patch kid.
    7. Tim Gunn has been at his best this season. I like that he’s bringing himself more into the proceedings.
    8. I also like Andy, but his designs are pretty hit and miss.

    Just Desserts:
    1. Holy cow are these people wackadoo. I don’t even know what to say. So much crazy on one show.
    2. I was disappointed when Heather C was brought back. I cannot stand looking at her too-long bangs. I know they are there to cover an injury or something on her forehead, but I just want to grab them and put them in a barrette.
    3. The only two I sort of like are Erica and Eric.

      Runway: Agree down the line. Mondo has perhaps the best combination of top-notch skills and intrinsic sweetness/likeability of any contestant I can remember from any reality show ever. Despite being from Colorado (I kid, I kid).

      Gretchen is tiresome, but she makes for great TV. This whole batch on Runway contestants has been great that way. This has been a very good season, maybe the best yet, and it illustrates how it is NOT easy to put together a good reality show…not just with insightful casting, but with one excellent host in Tim, a reasonably good spokes-hostess in Heidi, and good judging with Michael Kors and Nina Garcia. PR sufered greatly last year when Michael and Nina were only part-timers.

      By contrast, Just Desserts leaves a lot to be desired. An abundance of psycho contestants doesn’t mean engaging TV (except in the train wreck watching sense), Gail doesn’t have the talent to shoulder the hosting role without Colicchio, and tattooed other host dude is horrible, adding absolutely nothing. For these or whatever other reasons, I end up not really being able to tell which desserts are really good from what I see and hear (unlike the Top Chef mothership, where the production really does leave me with pretty distinct impressions of the food.

They are doing another one this fall, presumably where they bring back former contestants for some sort of cook-off–maybe a redemption show. I saw Marcel and Richard Blaize from the promo…

        The nice thing about PR this year is that by ditching the models show (and really the models entirely) and bumping it up to 90 minutes, they’re getting more depth from the contestants. You really do get the sense of what a grind the production schedule is and the toll it takes on their spirits. I think that is making the designers a bit more interesting. Though with the added time I think they could show a bit more of the work in progress. Often I feel it is not until the runway show that I even see what the garments really look like.

    In August of last year, we heard GM’s then-CEO Fritz Henderson claimed with all the marketing might it could muster at a Detroit-area press event, that the Chevy Volt would get 230 MPG in city driving conditions. Now, as the Volt’s being tested by the auto trade press, we’re seeing some surprisingly low fuel economy figures amid the expected lavish praise buff books are heaping upon the Volt.

    Let’s see what they’ve found out. Popular Mechanics saw just 37.5 MPG in city driving.

    On the other hand:

    Without any plugging in, [a weeklong trip to Grandma’s house] should return fuel economy in the high 30s to low 40s.”

    So for me the question remains: If I bought one, drove it to work and back, and plugged in at night would it use any gas?

      According to wikipedia

      The Volt works as a series hybrid at speeds lower than 70 miles per hour (110 km/h), as the internal combustion engine only acts as a generator to power the electric motors. In order to improve high-speed power, the internal combustion engine engages mechanically to the output from the transmission and assists both electric motors to propel the Volt up to its top speed of 101 miles per hour (163 km/h), then acting as a power-split or series-parallel hybrid, operating like the Toyota Prius.

      So if your commute is < 40 miles round trip, and < 70 MPH top speed, you wouldn't use any gas. Of course, any kind of "MPG" measurement for such a vehicle is probably stupid, as I think we've discussed here previously.

    Heard on radio on drive home, a partial answer to “down 0-2 comeback in five-game series” question from Friday: There have been 40 previous five-game series’ in MLB which have begun 2-0; on only four occasions has the trailing team won twice to force a Game 5. However, in all four cases the previously trailing team also won Game 5 to complete the comeback.

    These words were uttered by Bobby Valentine, so they may be wrong (and were certainly spoken with supreme smug assurance).

    So….Imma go ahead and say this here because it would be dishonest of me not to. I’m rooting for the Yankees against the Rangers.

    If the Rangers win the ALCS, there are four possible outcomes from that point, three of which I consider to be negative.

    1. Rangers win, Phillies win. Phillies win World Series. Obviously the best case scenario for the average Ranger-hater.

    2. Rangers win, Phillies win. Rangers win the World Series. I want you think back, those of you that remember, of what and how we viewed the Slegna prior to 2002. Granted, in that instance, it was best the Slegna won, but we created something there. Before 2002, the Angels were a joke. They were an also-ran. They were whipping boys. Which, quite honestly, is how I feel about the Rangers now. If they win though…they become the Slegna, but instead of rally monkey, we throw in Texas and Jesus and make an all new fucked up cocktail o’ fun.

    3. Rangers win, Giants win. Rangers win the World Series. Obviously, this is what I’ll be rooting for if it comes to that. But seriously, what’s gonna be more odoriferous to us as A’s fans in the future: hearing about how the Yankees have won 28 titles instead of 27 or hearing about how the Rangers are World Champions?

    4. Rangers win, Giants win. Giants win the World Series. Armageddon. All of us have to relocate our friends and family to the island of Alameda, which may be the only Giants-free zone left in the Bay Area (though they actually don’t seem too big in Richmond).

    Listen, politics and sports sometimes make queer bedfellows, and I’m rooting for pinstripes, bitches. And I despise the Yankees. But I don’t wanna hear about how Jesus and the great sovereign state of Texas made it all possible. So, go A-Rod! Go Jesus’s Puppy! Woooo!
