    Somehow Detwiler managed to hit a batter and give up two hits in the 5th and faced Beltre with the bases loaded without…nah, I didn’t think of any other possibility there. I needed to pee and knew what was going to happen, but stuck around anyway to see how far the ball would go.

    Mount Coco finally blows. I’m sorry, but given what he’s provided the A’s compared to the money he’s taken the last few years, I have no sympathy. He gets a buyout payment, he’s a free agent and if one of the other 29 teams thinks he’s worth $13 million in 2017 I’m thrilled for him.

      This is a tough one. I think I’m mildly on #teamcoco, because Coco is an awesome guy who has been a great A and I don’t like players being benched for money reasons. That said, this kind of contract leads to terrible incentives, and he had to know this was a possibility when he signed it.

    what a shitty day.

    was ordered to trial even after twice requesting a 130 start so i cold go to the first day of school. CLient had an anxiety attack and had to go to the doctor.

    There was a line to sign up for aftercare and we were assured spots. But no conformation came and SLF tried many ways of contacting them without response. finally 25 minutes after school was out, they said there wasn’t enough staff and for “safety reasons” we were waitlisted (the elder just leaves and goes to his library, the younger likes to stay and play).

    SLF got there 45 minutes after school ended to find the younger alone, waiting and having been stung by a bee. (slf is alergic, turns out the younger is not)

    judge yelled at me and co defendant’s counsel demanding to know what they are thinking. then demanded that I find law tonight that says the city attorney and the DA are the same agency (for no reason whatsoever).

    i could say more more but am too tired.

        its made worse by the contentious bidding on the after care program that the principa (who I still have never met or spoken to) insisted on which effectively shut out the aftercare provider from the last 10 years.

          Just awful.

          I’m worried that is my tomorrow. I’ve told the boss I need to leave early since I have no clue if the afterschool program will even be running. LAUSD is the biggest cluster I have ever seen. Went last week to get the schedule and stuff for Lil Miss Aces as she is starting HS. THey said I would need to bring copies of her transcripts (from the LAUSD Jr High she ended last year in). THe Jr high told me straight out that they refuse to give them to me because everything has been sent electornically. I was THIS close to just calling one school and giving the phone to the other and telling them to fight it out while I wait.

          Meanwhile I am now ready to fire my entire team at work. It should not be that hard to find people who can handle their current job: sitting at a desk putting on makeup and watching TV while Rome burns…

            a bunch of horse shit about how great the community is and how wonderful that more people than ever have signed up for aftercare and how mandatory staffing level may be in place by the end of next week!

            its like he didn’t even think that the reason 8 teachers left this year wasn’t because they can’t afford to live here and that maybe the parents might have to work too otherwise they couldn’t live here either.

            my question is, since there was only ever 2 teachers per class how is there not 2 for every grade level?

      so, what a odd trial.

      the issue is a totally unconstitutional civic ordinance. A homeless couple cited for camping and “ordered to vacate park for 24 hours. 23 hours and 58 minutes after the citation, the ranger returned and cited them for failing to heed the order. A Misdemeanor. they were cited 2 more times for failing to stay away.

      we filed a constitutional challenge. denied. we said fine. We were now aiming for an appeal after conviction and maybe a con law group would take it on. Judge was personally offended that we were not settling.

      He yelled and screamed at us (my co counsel is a true believer, which is good, but you need to know when it is just going to hurt you and your client, no matter how right you are). Co counsel, ignored my advice and opened with an issue that the Judge and perhaps the prosecutor didn’t think of. I really really wanted to spring this on them, with their witness (subpoenaed by us) who they hadn’t intended to call.

      just after that, and before my opening the judge called us (dramatically) into the hall and yelled at the three attorneys for making this a circus and there will be NO calling the prosecutor “the government” NO arguing at opening (which is a rule, but we tend to get a little slack).

      we all come back in to a silent and staring jury and I begin my opening. I am about done, when I say a sentence, that I hear as I am speaking is an argument. I try to stop, but don’t.

      “SIR!! I have addressed this and will not have it!”

      I smile broadly and find a friendly juror face. “I understand judge. I heard it too”

      after the Prosecutor (a city attorney doing what i imagine is his first real trial) is done with direct on the first witness, it dawns on the judge that one of our defenses is no jurisdiction, which is a legal issue.

      he kicks the jury out and orders us to have an evidenciary hearing with the cop that we were going to call. (i have no idea if this was appropriate because it was so fucking weird, I have never heard of such an event). Of course since co counsel had alerted the Opposition of our defense, they were already in process of cleaning up his testimony. The cop came in and changed his statement enough and said he was wrong before that it wasn’t a question of law but a qustion for the jury. Jury comes back in, we continue with the evidence. more arguing at the bench, more telling me how bad I am, more threats.

      we stayed late worked some stipulations out.

      i get to court today, tired and drained. I run into my boss leaving. I tell him how shitty I felt. He says the judge was raving about me.

      we have a couple of witnesses today. I think I did pretty well. as the jury is filing out we get called to the bench again, the judge is muttering that “you are going to win” “this is going to end up an acquittal”

      since the two defendants had another case pending they made an offer to dismiss this case and have them plea to one of the other 6 charges in another case, put over sentencing for a year and dismiss at that time if they stay away from the park.

      I guess it a win, but I feel so bad about it though.

        I don’t think even that would do it. It’s pretty clear that people see Clinton as more prepared and better suited temperamentally to handle a crisis. There might be an uptick in muslim-hatred, but not enough to offset Trump’s deep hole in that area.

        If he has a chance, it has to be some truly horrible revelation about Clinton. And it’s honestly pretty hard to imagine what that revelation would be at this point, given that people are pricing in their doubts about her honesty and still going for her overwhelmingly because they hate Trump and mostly like Obama.

      Perhaps when Semien comes back, rather than sending Pinder down they will send Ladendorf, whose veteran acumen would be a steadying influence on the Sounds in their postseason run.

      The A’s have really jerked the Sounds around on the pitching side but they’ve been more stable on the lineup, especially on the infield. With nothing at stake in Oakland, it’s good affiliate relations, both with ownership and fans, if the A’s minimize the Sept. 1 callups and put the best possible team at Nashville for as long as they go. Phegley and a bullpen arm should do it, though I figure the A’s will trade Rzep somewhere by August 31 and will need a replacement for him as well.

      This is probably the dumbest managerial decision I’ve ever seen in baseball. I mean even if the A’s trying to throw the game, I don’t think they would’ve made it this obvious.

      The only way this might make sense is if the on deck batter was a pitcher and you’re facing vintage Barry Bonds. Even then, you’re bringing into play so many other factors, anything from a walk to a medium fly ball to a WP to (ding ding ding) a HBP, that leaves you no margin for error.

      I can only assume this horrendous roster, the losing, and all the Coco drama has made BoMel lose his mind.

        Not a lot of barriers to entry here either. Fact is there was a pretty limited audience for what they were offering, as it was always a New York media insidery wankfest (peppered with the occasional very good piece of journalism or essaying). Once Denton was bankrupted, there was really no economic model for keeping the site (as distinct form the other Gawker Media sites) going, I imagine.

          The real issue is that the big companies get deemed too big to fail and they don’t follow through with that ideology. And they just stick it to the little/mid size guy. If it was done across the board, I’d agree with it. So long as public safety nets were there for the innocent.

              According to some earlier stories, the full amount of liabilities minus assets was actually something like $70M. The short answer is that it was basically a Ponzi scheme that a) was mostly based on wine futures (i.e. I will gladly pay you today for a bottle of Bordeaux in 2021) which weren’t expected to be delivered immediately anyway; and b) he managed to keep going for an impressive amount of time.

              Still, I haven’t seen anything that really makes sense of where all the money ended up. They say he “embezzled at least $5 million of that money” and also that in some cases they ended up taking a loss on some bottles, paying more for a bottle than he had charged the customer so that he could actually deliver it and keep the scheme going a little longer. That still seems to leave an awful lot of money unaccounted for.

    The 538 polls-only forecast (86.2%) and nowcast (87%) have nearly converged. Also, polls-only thinks she’s favored to win Arizona on November 8, while the nowcast thinks Trump would be favored to win it today.

    That model is weird as hell.
