                  one I thought was a winner, but there was no real offer. 2nd bad offer, third, I had an argument, but it was an uphill battle (picture of the guy in a stolen truck is kinda bad news for the possession of a stolen truck count)

                  What kind of in limine? Abuse of discretion is a nasty standard unless you’ve got a clean legal issue.

                  That said, my upcoming oral argument features a 5th Amendment exclusion that wasn’t right, and that’s not even abuse of discretion in the first place.

                  the in limine was a pretty straight forward pre miranda custody interrogation statement, I thought.

                  Guy is pulled out of car, handcuffed, pat searched for weapons, pills are found and he is asked a question. he answered. Its what the jurors said sunk me.

                  As for the jury statements, I believe they are only available on a habeas pettition for misconduct or something. I don’t think this rises to that level.

                  @DFA “in limine” motions are pre trial motions that guide what evidence can and cannot be admitted during a trial.

                  shepardizing is the act of checking to see if a particular point of law has been overturned or disfavored.

                  So, if I was trying to argue that seperate but equal education was legal and I wanted to cite Plessy v Ferguson, I would look up what cases have cited this one and see if there was anything that overturned it.

                  Prior to computers and databases, there was a service run by a guy named Sheppard that published books that did that for you. The was a complicated coding system that made you jump from book to book to discover if PLessy was still good law.

                  The legal community verbified his name to “Shepardizing”

                  One thing I wanted to point out, my clients often say “lets take this to trial, they’ll give me a better deal just before the jury gets seated because they don’t want to waste all that money on a stupid trial like this one.”

                  I always tell them , no, in fact they prosecutor doesn’t give a shit about the money, they will stop pursuing this when you do.

          The A’s have always had minimal spring radio coverage as long as I can remember. Usually nothing until the second week, then mostly only weekends until the last week or two. While it may be lame, this is not a new failing by 95.7.

            I can understand not wanting to produce the broadcasts at all, especially on a weekday afternoon when almost no one can listen. But if there’s a broadcast to air, it’s pretty weak of the flagship not to carry it.

                Oddly, the top-of-the-hour station ID on the MLB.com broadcast just identified the station as 95.7 The Game, so they must be producing the broadcast for the network stations in San Francisco, but the station isn’t carrying the game. I bet they do have a contractual obligation to carry the ESPN programming through the end of February.

                  They have a huge ad budget. There’ve been a couple of times when I’ve been on 95.7 and heard the gravelly-voiced announcer say “If you were here, you know…” and lunged for the dial, only to find the ad finishing up on KCBS, “together, we’re…”CLICK. It’s more repellent than 1-877-KARS-for-KIDS.

    So I’m driving home from work yesterday and one of the local radio stations plays a lot of live music and Genesis comes on playing Invisible Touch…in the live version instead of singing “mess” Phil sings “fuck”…now I thought for sure that they’d bleep this since I’m pretty sure you can’t say that on radio but no, they did not. I got a chuckle thinking about the poor, sensitive ears of the fine folks of Arkansas hearing the word fuck on the radio. I’m pretty sure that radio station will switch to Christian music by the end of the month.

      Oh, also I missed almost the entire half on the DVR because ESPN was still on the auto race at Daytona which ended in a horrific wreck, including a tire and an engine flying into the stands. Miraculous that no spectators died.

        Yes, the way ESPN crams their events into too-short time slots (which they do because studio shows filling time between games tend to lose audience) you’re wise to set the DVR to record ESPNNews for the first 30-60 minutes of the time slot of the game you want to watch.
